Hornell police officials are saying that the accident took place on April 27. The ironworker was injured when bars that he was attempting to assemble tipped over and fell on top of him.

Paramedics were called to the scene of the accident to help the victim. He was transported to Strong Memorial Hospital in a medical helicopter.

A full investigation into the cause of the accident remains ongoing at this time.

Liability for Hornell Industrial Accidents

Employers in New York have a legal obligation to protect workers from foreseeable sources of harm. If a construction site is in a dangerous condition, and this contributed to a worker’s injury, the owner or operator of that site could be liable. Pursuant to New York Labor Law 200, “All machinery, equipment, and devices in such places shall be so placed, operated, guarded, and lighted as to provide reasonable and adequate protection to all such persons.” There are several ways a worksite may be in a dangerous condition.

  • Workers may not be provided with fall protection.
  • Debris on the floor of a worksite could create a tripping hazard.
  • Electrical equipment may not be properly grounded.
  • Heavy machinery may lack adequate guards to prevent workers from being entangled.

The vast majority of workplace accidents are preventable. They tend to be the result of violations of OSHA safety guidelines. This can include situations where loose materials are placed over workers. Any person injured in a construction accident in New York may have legal recourse through a civil claim. Damages in a civil claim can help cover lost wages, medical bills, and pain and suffering. A construction accident attorney can examine all of the unique facts of your case and let you know what your legal options are.
