Liability For Rochester School Bus Accidents

Buses tend to be very safe for their passengers. But they can be very dangerous for pedestrians and those in smaller vehicles. According to the National Safety Council, “From 2012 to 2021, about 70% of the deaths in school bus-related crashes were occupants of vehicles other than the school bus, and 16% were pedestrians. About 5% were school bus passengers, 5% were school bus drivers, and 3% were pedalcyclists.” There are many steps that bus drivers should take to avoid collisions.

  • Bus drivers should check their blind spots before turning.
  • Bus drivers should slow down at night and during times of inclement weather.
  • Bus drivers should be well rested before starting their shift.

Bus companies are considered common carriers and must do everything that they can to avoid collisions. Pursuant to New York Vehicle Code 1146, all drivers must exercise due care in order to avoid hitting pedestrians, bicyclists and domestic animals in the roadway. If a school bus driver fails to slow down to avoid hitting a pedestrian, this could form the basis of a negligence claim. Victims of bus accidents often suffer serious injuries including:

  • Broken bones
  • Tendon damage
  • Concussions
  • PTSD

The vast majority of pedestrian accidents are preventable and involve some amount of driver error. It is common for accident victims to need to take long periods of time off of work. Sadly, though, it is even more common for bus companies to do everything in their power to deny responsibility if one of their drivers hits a pedestrian. Any person that is injured in a car accident may have legal recourse through a bodily injury claim.
