NYSTLA President Edward Gersowitz, senior partner Jeff Korek, and the other partners and attorneys at Gersowitz Libo & Korek P.C., had the opportunity to attend Civil Justice Lobby Day. This New York State Trial Lawyers Association (NYSTLA) event provided an opportunity to discuss a variety of issues critical to the rights of New Yorkers.
– Auto Fairness: NYSTLA supports bills that address the need for sufficient insurance and consumer protection, such as increasing the minimum level of required insurance from $25K to $250K.
– Grieving Families’ Law: NYSTLA supports laws to modernize New York’s outdated wrongful death law to allow damages for emotion loss or harm, as well as the bill to extend the statute of limitations in toxic torts cases. The Assembly Judiciary Committee voted in favor of The Grieving Families Act.
– Fair Claims Settlement: NYSTLA supports the passage of legislation promoting insurance claims fairness that would provide a cause of action against insurance companies for bad faith practices dealing with insurance claims. The law would also provide the insurance companies an incentive to promptly pay on claims.
– Lavern’s Law – Date of Discovery: NYSTLA supports Lavern’s Law, which would start the statute of limitations when a patient discovers malpractice, rather than when it happens. In other words, the Date of Discovery rule would allow the statute of limitations for medical malpractice, which is two-and-a-half years, to start running from the date that the plaintiff discovered or reasonably should have discovered the malpractice. The Committee voted in favor of Lavern’s Law.
