Liability for Freeport Apartment Fires

Residential fires remain a leading cause of preventable injury and death across New York City. According to the New York Fire Commissioner, “There were 23,901 structural fires in Fiscal 2023, a two percent increase compared to 23,387 in Fiscal 2022.There were 12,594 non-structural fires in Fiscal 2023, a seven percent decrease compared to Fiscal 2022. Total fire company runs between Fiscal 2022 and Fiscal 2023 increased 3 percent.” There could be multiple causes of any apartment fires.

  • An apartment fire could be the result of lithium-ion batteries that exploded.
  • Many fires are due to malfunctions with the building’s electrical system.
  • Cooking accidents are another major source of residential fires.

Property owners in New York have a legal obligation to maintain the premises in a reasonably safe condition. This necessitates that they abide by all fire and building codes. When an apartment owner has actual or constructive notice that their building is in a dangerous condition, they must take action. If an apartment has blocked exits that prevent people from escaping a fire, this could serve as evidence of negligence.
