Liability for Verona Elevator Accidents

Business owners in New York have a legal obligation to maintain work sites in a reasonably safe condition. According to New York Labor Law § 200, “All places to which this chapter applies shall be so constructed, equipped, arranged, operated and conducted as to provide reasonable and adequate protection to the lives, health and safety of all persons employed therein or lawfully frequenting such places.” There are many mistakes that could have contributed to any elevator accident.

  • An elevator may not have received periodic inspections and maintenance.
  • An elevator may have been hauling a load beyond its carrying capacity.
  • An elevator may have worn components that break over time.

Employers in New York can be liable for accidents at construction sites. Among other things, employers can be liable through New York Labor Law § 240, the ‘Scaffold Law.’ Under the statute, employers can be liable for gravity-related accidents. This includes all situations where a worker is injured in a fall or hit by a falling object. Victims are able to pursue damages for all of the ways that the accident has impacted their lives.
