Falls remain one of the leading causes of injury and death in the United States. Ladders can be particularly dangerous. According to the University of South Florida, “In 2023, the American Academy of Orthopedic Surgeons reported that 500,000 people were treated for ladder-related injuries, with 300 of these incidents proving fatal.” There are a number of common causes of ladder falls.

  • The incorrect ladder for the task at hand may have been used.

  • The ladder may have been placed on an uneven or unstable surface.

When a worker is injured in a fall, a building owner, construction company or general contractor can be held liable under New York State Labor Law § 240. Commonly referred to as the “Scaffold Law” New York State Labor Law § 240 imposes strict liability on construction companies, contractors, and building owners when a worker falls or is hit by a falling object. It is important that certain steps are taken after any ladder accident.

  • Eyewitnesses should be interviewed.
