Cyclist Died in Borough Park Dump Truck Accident

53-Year-Old Died in Borough Park, Brooklyn Dump Truck Collision by 16th Avenue and 49th Street

BOROUGH PARK, BROOKLYN (April 24, 2026) – A 53-year-old cyclist has tragically died in a Borough Park, Brooklyn car accident with a dump truck by 16th Avenue and 49th Street.

New York City officials are saying that the accident took place around 3:00 p.m. on Wednesday. A cyclist was heading down the road when he was stuck by a 2021 Mack cement truck.

Paramedics were called to the scene of the collision to help the victim. He was transported to the hospital in critical condition.

A full investigation into the collision remains ongoing at this time.

Liability for Borough Park Cement Truck Accidents

Dump truck drivers must obtain a commercial license and are expected to operate the vehicles with a great deal of care to avoid hitting the pedestrian roadway. According to New York Vehicle and Traffic Law §1151, “the driver of a vehicle shall yield the right of way, slowing down or stopping if need be to so yield, to a pedestrian crossing the roadway within a crosswalk on the roadway upon which the vehicle is traveling, except that any pedestrian crossing a roadway at a point where a pedestrian tunnel or overpass has been provided shall yield the right of way to all vehicles.” There are many different reasons that a dump truck collision may take place.

  • A dump truck driver may have been traveling too fast for the prevailing conditions.
  • A dump truck driver may have failed to check their blind spots before turning.
  • A dump truck driver may be operating under the influence of prescription drugs.

If a dump truck driver fails to slow down to avoid hitting any pedestrian in the roadway, this could serve as evidence of negligence. It is also possible that liability for any cement truck accident could extend beyond a truck driver determined to be at fault. The company that a dump truck driver worked for may also be held at fault. As a general rule, employers can be liable for the negligent actions of their employees who are working within the course and scope of their job duties.
