Liability for Staten Island Construction Accidents

Construction accidents during excavation work are unfortunately quite common. According to Safety and Health Magazine, “Thirty-nine workers died while performing trench/excavation work in 2022, up from 15 in 2021, according to a new report from CPWR – The Center for Construction Research and Training.” Companies should take a number of measures in order to prevent excavation accidents.

  • Construction companies should perform a site assessment of underground utilities and the soil before beginning.
  • Construction companies should ensure that the walls of any excavated dirt are at an appropriate angle.
  • Construction companies should ensure that a competent person inspects trenches before each work session.
  • Construction companies should ensure that the walls of trenches are properly shored up.

Construction companies have a legal obligation to maintain work sites and a reasonably safe condition. Pursuant to New York Labor Law § 200, “All machinery, equipment, and devices in such places shall be so placed, operated, guarded, and lighted as to provide reasonable and adequate protection to all such persons.” It is important that certain steps are taken after any New York construction accident.

  • An investigation by OSHA should be conducted.
  • Accident victims should seek medical care.
  • Medical records related to the accident should be preserved.
  • An experienced construction accident lawyer should be contacted.

Construction accidents can be extremely traumatic for workers. Not only are workers often seriously injured by these incidents, but they may also need to take extensive periods of time away from their jobs. This can put an enormous financial strain on both individuals and families. Any person injured in a construction accident may be able to seek some measure of justice through a civil claim.
