Far too many pedestrians are killed or seriously injured in car accidents every year across New York City. According to the New York City Department of Health and Mental Hygiene, “Preventing traffic-related injuries and deaths is the goal of New York City’s (NYC) Vision Zero initiative. Between 2012 and 2014, there were 497 pedestrian fatalities, accounting for more than half of the total 889 traffic- related fatalities in NYC.” There are a number of common causes of pedestrian accidents.
The vast majority of pedestrian accidents are preventable and involve drivers who are committing traffic infractions. In particular, many pedestrian accidents involve drivers who fail to yield. Pursuant to New York Vehicle Code 1172, the driver of any vehicle approaching a yield sign shall stop and only proceed when it is safe to do so. If a driver hits a vehicle after going past a yield sign without yielding, this may be considered prima facie evidence of their failure to yield. Victims of pedestrian accidents often suffer very serious and costly injuries including:
Depending on the facts of any case, liability for a truck accident could extend beyond any driver. The company that a truck driver worked for could be liable for a collision. Generally speaking, employers are typically liable for the wrongful actions of their employees – insofar as those employees were working within the course and scope of their job duties. For example, a truck driver may have been delivering products when they crashed.
