Liability for New Jersey Dump Truck Accidents

Commercial trucks can be incredibly dangerous for pedestrians and those in passenger vehicles. According to the IIHS, “A total of 4,354 people died in large truck crashes in 2023. Sixteen percent of these deaths were truck occupants, 65% were occupants of cars and other passenger vehicles, and 17% were pedestrians, bicyclists or motorcyclists.” There are many reasons that a dump truck collision may take place.

  • Dump trucks can weigh tens of thousands of pounds and are incredibly difficult to operate, even in the best of circumstances. Many collisions involve drivers going at unsafe speeds around curves.
  • A large portion of serious injury collisions involve intoxicated drivers. What many drivers don’t realize is that they can be intoxicated by a variety of substances besides alcohol.
  • Driver distraction continues to play a major role in many truck collisions. A truck driver could be distracted by their phone, GPS, or conversations with other people.

Truck drivers will typically need a commercial license and must operate with an abundance of caution. They are required to be intimately familiar with how their vehicle operates in all circumstances. There is a presumption of negligence on the part of any truck driver that hits another vehicle after crossing into opposing lanes of traffic. Several actions should be taken after any truck accident.

  • The police should be called to the scene so that they can begin an immediate investigation.
  • The driving record of the truck driver should be scrutinized.
  • Evidence related to the crash site should be preserved, including photographs.
  • An experienced truck accident attorney should be contacted.

Given the sheer size and weight of trucks, even a low-speed collision can potentially be catastrophic. Victims often sustain injuries that could take weeks or even months to heal. Many people are so seriously injured that they are left with permanent disabilities. Any person that is injured due to the negligent actions of a truck driver may be able to seek some measure of accountability through a personal injury claim.
