We see guardrails on highways and automatically assume that they are safety devices designed to keep us on the roadway instead of in a ditch in the event of an accident. Guardrails were designed to prevent vehicles from leaving a roadway and veering into potentially even more dangerous territory.
However, a recent study has raised serious doubt about the real safety of at least one type of guardrail system which may not be doing its job. The study has linked the redesigned ET-Plus guardrail system manufactured by Trinity Industry to catastrophic injuries and even deaths.
One of the most common types of injuries suffered by guardrail accident victims is a limb amputation. The guardrail terminals, the start and end pieces of the metal guardrails, are meant to absorb the energy from the impact of vehicles during an accident. However, studies show that lost limbs resulting from the guardrail terminals piercing through the vehicles are widespread. In fact the majority of the lawsuits brought against Trinity Industries are filed by victims who have suffered lost limbs in guardrail accidents.
Unfortunately, regardless of what type of injury you suffered as a result of the Trinity guardrail system, it will no doubt significantly impact your life and the lives of your loved ones.
If you or someone you know has been injured in an accident involving a highway guardrail, you may be entitled to compensation. In order to determine whether you are entitled to compensation, you should consult with an attorney who specifically handles these types of cases.
