Liability For Brooklyn Car Accidents

Speeding remains one of the leading causes of car accidents in the United States. According to the National Safety Council, “Speeding was a factor in 29% of all traffic fatalities in 2022, killing 12,151, or an average of over 33 people on a typical day. The total number of fatal motor-vehicle crashes attributable to speeding was 10,922. ” Several other factors could contribute to any car accident.

  • Distracted driving
  • Inclement weather
  • Poor road conditions
  • Driver intoxication

Every driver must use caution in order to avoid collisions. They must exercise due care and slow down when necessary in order to avoid colliding with other vehicles. There is a rebuttable presumption of negligence on the part of any driver that fails to slow down and collides with a vehicle in their own lane of traffic. It is important that certain steps are taken after any car accident.

  • Surveillance footage should be sought.
  • Medical records should be collected.
  • Eyewitnesses should be interviewed.
  • A personal injury attorney should be contacted.

The vast majority of car accidents are preventable. They tend to involve situations where drivers are violating traffic regulations. Any person that is injured in a car accident may be able to seek some measure of justice through a civil claim. A personal injury attorney can examine all of the unique facts of your case and let you know what your legal options are.
