Liability for New York Boat Accidents

Boats remain a popular form of recreation, but they are also involved in many serious injuries every year. According to the United States Coast Guard, “Fatalities fell by 11.3 percent to 564 from 636 in 2022, while overall incidents decreased by 4.9 percent from 4,040 to 3,844. Non-fatal injuries also declined by 4.3 percent from 2,222 to 2,126. Alcohol continued to be the leading known contributing factor in fatal boating accidents in 2023, accounting for 79 deaths, or 17 percent of total fatalities.” Several other factors could cause an accident.

  • Boat accidents are more likely when boat operators are inexperienced.
  • Boat accidents often occur due to inclement weather.
  • Boat accidents may involve boat operators who are distracted.

Boat operators have a legal obligation to exercise due care to avoid colliding with swimmers and other boats in the water. They must observe all speed limits and navigation rules. In particular, boat operators should slow down in areas with heavy traffic. If a boat operator was working at the time of a collision, the company that they were working for could be at fault. Generally speaking, companies are vicariously liable for the wrongful actions of their employees working within the course and scope of their job duties. Victims of boat accidents tend to suffer very serious injuries.

  • Broken bones
  • Head injuries
  • Lacerations
  • Spinal cord injuries
  • Death

Most boat accidents are preventable. They tend to involve inexperienced drivers who are traveling too fast for the prevailing conditions. Unfortunately, drivers and their insurance providers will often do everything in their power to deny responsibility for an accident. This is where an attorney can prove to be enormously useful. An attorney can take steps to ensure that accident victims get the support and compensation that they need to recover.
