Liability In Suffolk County Construction Accidents
Falls remain one of the leading causes of serious injury and death for construction workers. In fact, the Occupational Safety and Health Administration (OSHA), has listed falls as one of the “fatal four” causes of workplace injury. Around 35.6% of all workplace deaths are due to falls. For the most part, falls are totally preventable. Here are just a few of the steps that companies can take in order to prevent falls.
- Guardrails should be installed in certain locations.
- Workers should receive personal fall arrest systems (PFAS) when they work at elevated heights.
- Workers should be properly trained to recognize potential hazards.
- Unsafe locations should be properly sealed off by warning signs and caution tape.
General contractors and building owners are held strictly liable for gravity related accidents. This includes instances when a worker falls or is hit by a falling object. According to New York Labor Law § 240, the statute applies for workers engaged in the “erection, demolition, repairing, altering, painting, cleaning or pointing of a building.” However, the statute creates exceptions for one and two family dwellings. A construction company could also be held liable through New York Labor Law § 200 if a workplace was in a dangerous condition. There are a number of steps that should be taken after any construction accident.
- Medical records should be preserved.
- Eye witnesses should be interviewed.
- Work records and safety records should be sought.
- An experienced construction accident attorney should be consulted.
Any person that is injured in a construction accident may have legal recourse through a bodily injury claim. Damages can help cover lost wages, medical bills and pain and suffering. Victims of construction accidents tend to not realize the full extent of their injuries until several weeks or months after an accident. This is why it’s so important to continue to seek medical care if you’ve been injured on the job. A construction accident attorney can examine all of the facts of your case and let you know what your legal options are.
