Liability In Bronx Trench Collapses
Based on one report from Equipment World, 2019 was one of the deadliest years for trench collapses. One of the leading causes of trench collapses is inadequate cave-in protection. There are a number of measures that can be taken to reduce the likelihood of trench collapses.
- A qualified person should inspect the trench before the start of every shift.
- The walls of trench should be adequately guarded.
- The soil should be examined before a trench is first dug.
Depending on the specific facts of any case, a construction company could be liable for an accident if a worker is injured in a trench collapse. According to New York Labor Law 200, companies must maintain their premises in a reasonably safe condition. When a construction company fails to follow OSHA regulations and creates an unsafe environment for their workers they could be liable in the event of an accident. There are a number of items that should be investigated after any trench collapse.
- Did the trench have adequate cave-in protections?
- How often was the trench inspected?
- What is the safety history of the construction company involved in the accident?
Trench collapses can leave workers with serious and lasting injuries. Any person that is injured on the job may be able to seek aid through a bodily injury claim. Damages can help cover lost wages, medical bills and pain and suffering. A personal injury attorney can examine all of the unique facts of your case and let you know what your legal options are. There are, however, statute of limitations associated with civil claims.
