Liability In Bronx Pedestrian Accidents

Thousands of people are seriously injured or killed every year in pedestrian accidents. Pedestrians have a naturally small profile and are more likely to be overlooked by drivers. It has been estimated that nearly 93% of all pedestrian accidents involve some element of human error. There are a number of factors that could potentially contribute to a pedestrian accident including:

  • Speeding
  • Drunk driving
  • Inclement weather
  • Driver distraction

All drivers have  a legal obligation to exercise due care in order to avoid hitting pedestrians. In most circumstances, the owner of a stolen vehicle will not be responsible if their vehicle is involved in an accident. But their are exceptions to this rule. According to New York’s Vehicle and Traffic Law § 1210, the owner of a vehicle that is stolen could be liable for an accident involving their vehicle if they left their keys unattended in the ignition. Keys in the ignition create an attractive target for thieves and could form the basis of a negligence claim. Victims of pedestrian accidents tend to suffer very serious and costly injuries including:

  • Broken bones
  • Head injuries
  • Lacerations
  • Organ damage

Any person that is injured in a car accident may have legal recourse through a bodily injury claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. Many victims may not realize the full extent of their injuries for several months or weeks after an accident. A New York City pedestrian accident attorney can examine all of the facts of your case and let you know what your legal options are.
