Liability For Rochester Pedestrian Accidents

Far too many pedestrians are killed or seriously injured in collisions every year. According to the Insurance Institute for Highway Safety (IIHS), “A total of 6,205 pedestrian deaths occurred in 2019. Pedestrian fatalities decreased 3 percent from 2018, but still account for 17 percent of all crash fatalities. Although pedestrian deaths were 17 percent lower in 2019 than in 1975, they have increased 51 percent since reaching their lowest point in 2009.” The vast majority of pedestrian collisions are totally preventable and due to driver error.

  • Drivers are more likely to hit pedestrians when they are speeding.
  • Drowsy driving can be just as dangerous as driving while intoxicated.
  • Drivers are more likely to hit pedestrians during periods of inclement weather when the roads are slick.

All drivers must exercise due care in order to avoid hitting pedestrians in the roadway. Many collisions are due to drivers that are speeding or distracted. If the driver that hit a pedestrian was working at the time of a collision the company that they were working for could be held at fault. Generally speaking, companies are liable for the negligence of their employees – insofar as the tortious conduct was reasonably foreseeable. There are a number of steps that should be taken after any pedestrian accident.

  • Surveillance footage should be sought.
  • Medical records should be preserved.
  • Eye witnesses should be interviewed.
  • A thorough, independent investigation should be conducted.

The family of any victim that died in a car accident may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. It is important that evidence is properly preserved after an accident. A wrongful death attorney can examine all of the facts of your case and let you know what your legal options are.
