According to the U.S. Bureau of Labor Statistics, \u201cIn 2024, there were 1,034 workplace deaths in the private-sector construction industry. Over one-third (389) of fatal injuries in construction were due to falls, slips, and trips, and 95.9 percent of these were falls to a lower level. Construction accounted for almost half (48.8 percent) of all fatal falls, slips, and trips in private industry in 2024.\u201d Construction companies should take several measures to prevent falls.Construction companies should provide workers with personal fall arrest systems if they are working at heights of 6 feet or more.Construction companies should set up guardrails and other safety barriers to prevent workers from falling from certain locations.Construction companies should develop a site-specific safety plan that addresses potential fall hazards. In New York, construction companies can be held strictly liable for falls under the scaffold law. The statute applies to most instances where a worker falls or is struck by a falling object. For the statute to apply, a worker must be engaged in some type of qualifying activity, such as the repairing, altering, or painting of a building.
