Woman Killed In Hamburg Car Accident on Lake Avenue

Female Pedestrian Died In Hamburg Car Collision Along Lake Avenue

Woman Killed In Hamburg Car Accident on Lake Avenue

HAMBURG, NEW YORK (April 10, 2023) – A woman has tragically died in a Hamburg pedestrian accident along Lake Avenue, according to New York State Police.

Hamburg police officials are saying that the accident took place around 8:40 p.m. on April 4. A woman was crossing in front of Our Mother of Good Counsel Apartments when she was hit by a car.

Paramedics were called to the scene in order to help the victim. Sadly, she died due to the severe nature of her injuries.

She was remembered as a loving person who fought to make Lake Avenue safer. Cars regularly sped through the area. Neighbors have complained about how dangerous Lake Avenue can be all the way back to 1992.

Liability For Hamburg Pedestrian Accidents

Speeding remains one of the most common causes of car accidents in the United States. According to the NHTSA, “For more than two decades, speeding has been involved in approximately one-third of all motor vehicle fatalities. In 2020, speeding was a contributing factor in 29% of all traffic fatalities.” There are many other factors that could contribute to a pedestrian collision.

  • Driver distraction
  • Driver fatigue
  • Inclement weather
  • Poor road conditions

All drivers must exercise due care in order to avoid hitting pedestrians. Pursuant to New York Vehicle Code 1146, all drivers must exercise due care in order to avoid hitting pedestrians, bicyclists and domestic animals in the roadway. If a driver fails to slow down to avoid hitting a pedestrian, this could form the basis of a negligence claim.

A city could potentially be liable for a pedestrian accident. Consider, for example, the 2016 New York Appeals Court ruling of Turturro v City of New York. The Court of Appeals held that the city of New York could be liable for  failing to “study or implement traffic calming measures” along a stretch of road that became known for speeding. There are many steps that should be taken after any pedestrian collision.

  • Eye witnesses should be interviewed.
  • Medical records should be preserved.
  • Surveillance footage should be sought.
  • Government records of accidents at the crash site should be sought.
  • A thorough investigation should be conducted.

The family of any person that is killed in a pedestrian accident may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. Sadly, though, drivers and cities will often fight hard to deny liability for any collision. This is why it is important that all evidence is properly preserved after any accident.
