Liability For Dunkirk Pedestrian Accidents
Pedestrians are nearly 1.5 times more likely to be killed in collisions than those in passenger vehicles. According to the National Safety Council, an estimated 7,668 pedestrians died in traffic crashes in 2019. Pedestrian collisions tend to occur on private property such as driveways and parking lots. There are a number of reasons that parking lots can be particularly dangerous.
- Parking lots are often poorly illuminated.
- Parking lots tend to lack clear pedestrian crossings.
- Cars can come from every direction in a parking lot.
Pursuant to New York Vehicle Code 1146, all drivers must exercise due care to avoid hitting pedestrians, bicyclists and domestic animals in the roadway. If a driver fails to slow down to avoid hitting a pedestrian, this could form the basis of a negligence claim. The family of any person that died in a car accident may have legal recourse through a civil claim.
