Liability In Brooklyn Hit-And-Run Collisions

Hit-and-run collisions are still far too common despite increased enforcement by police departments. According to the AAA Foundation for Traffic Safety, ” There were an estimated 737,100 hit-and-run crashes in 2015 (NHTSA, 2016). This translates to a hit-and-run crash happening somewhere in the U.S. every 43 seconds. The 2,049 fatalities that resulted from hit-and-run crashes in 2016 were the highest number ever recorded (NHTSA, 2017).” There are many factors that could potentially contribute to hit-and-run collisions including:

  • Poorly lit intersections
  • Speeding
  • Driver distraction
  • Driver fatigue
  • Drug use

It is illegal to flee the scene of any collision that results in bodily injury or death. All drivers must remain at the scene and exchange insurance information. When a driver fails to exercise due care and hits a pedestrian before fleeing, they can be held at fault through a criminal and civil claim.  There are a number of steps that should be taken after any hit-and-run collision.

  • Fragments of the fleeing vehicle should be sought.
  • Eye witnesses should be interviewed.
  • Surveillance footage should be sought.

The family of any victim that died in a car accident may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover lost wages, medical bills and funeral expenses. Potential beneficiaries in a civil claim may include a victim’s spouse and children. A wrongful death attorney can examine all of the specific facts of your case and let you know what your legal options are.
