Liability For Canandaigua Car Accidents
All drivers must exercise due care to avoid collisions. Pursuant to New York Vehicle Code § 1180, no person shall drive a motor vehicle at a speed greater than would be reasonable or safe given the prevailing conditions of the roadway. There is simply no reason a driver should ever rear-end another vehicle in their own lane. Indeed, there is a rebuttable presumption of negligence on the part of any driver that rear-ends another vehicle. Victims of car accidents tend to suffer very serious injuries including:
- Broken bones
- Head injuries
- Lacerations
- Spinal cord injuries
Any person that is injured in a car accident may have legal recourse through a bodily injury claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. Sadly, though, drivers and insurance companies will often fight hard to deny liability for any collision. A car accident attorney can examine all of the unique facts of your case and let you know what your legal options are.
