Liability For Brooklyn Pedestrian Accidents
Pedestrian accidents remain alarmingly common in the United States. According to the NY Department of Health, “Injuries to pedestrians are among the top 10 leading causes of injury-related hospital admissions and death for almost all age groups In New York State. Approximately 300 pedestrians are killed and 15,000 are injured by motor vehicles each year on the state’s roadways, and more than 3,000 pedestrians are admitted to the hospital annually.” There are many steps that drivers should take in order to avoid hitting pedestrians.
- Drivers should slow down at night and during periods of inclement weather.
- Drivers should check their blind spots before making turns.
- Drivers should abstain from alcohol and other intoxicating substances.
All drivers have a legal obligation to exercise due care in order to avoid hitting pedestrians. Drivers must slow down whenever a pedestrian is close enough so as to pose a hazard. If a driver fails to slow down to avoid hitting a pedestrian, this could form the basis of a negligence claim. Any person that is injured in a car accident may have legal recourse through a bodily injury claim.
