Liability In Brockport Forklift Accidents

According to one report from Injury Facts, there were 78 forklift accident deaths in 2020 and 7,290 nonfatal injuries. Forklifts are by their very nature dangerous machines. Workers must get specialized training in order to operate them. There are a number of factors that could potentially contribute to a forklift accident including:

  • Poor communication between workers.
  • Malfunctioning equipment.
  • Unsafe working conditions.
  • Operational error.

There are a number of laws designed to protect workers in the event they are injured. Any worker that is injured on the job may be able to seek aid through a worker’s compensation claim. Workers compensation is a no-fault system in New York. Depending on the specific facts of any case, an injury worker or their family may also be able to pursue a civil claim.

An employer could be liable for a worker’s death under New York Labor Law 200. This statute is a codification of an employer’s general responsibility to maintain their environment in a reasonably safe condition. There are a number of ways that a workplace could be in a dangerous condition. For example, a foreman or supervisor could be liable for an accident if they knew a forklift was in disrepair and let workers use it anyway. There are a number of steps that should be taken after a workplace accident.

  • Eye witnesses should be interviewed.
  • Surveillance records should be sought.
  • Medical records should be preserved.
  • A thorough, independent investigation should be conducted.

The family of any worker that died on the job may be able to seek aid through a wrongful death claim. Damages can help cover some of the unexpected expenses that come with the sudden loss of a loved one. It is extremely important that evidence is properly preserved after an accident. A wrongful death attorney can examine all of the unique facts of your case and let you know what your legal options are.
