Liability In Old Westbury Lanscaping Truck Accidents
Motorcyclists are naturally more vulnerable than drivers and passengers of enclosed vehicles. Motorcyclists are 29 times more likely to be killed in collisions than passengers per vehicle miles traveled. This is why helmets are so important. The NHTSA estimates that helmets saved the lives of 1,872 motorcyclists in 2017 alone. Factors that could potentially contribute to a motorcycle accident will include:
- Inclement weather
- Dangerous left turns
- Road conditions
- Driver distraction
Many accidents are due to truck drivers that make dangerous left turns. Trucks have large blind spots and can easily overlook motorcyclists in the roadway. Truck drivers must check those blind spots before turning. According to New York Vehicle & Traffic Law § 1141, drivers must yield the right of way to oncoming traffic close enough so as to pose a hazard. Only when that traffic is no longer an immediate hazard may the driver proceed to make a left turn.
Left turns are incredibly dangerous by their very nature. In fact, pedestrians are three times more likely to be killed by left turn collisions over right turns. Left turns are 10 times more likely to contribute to a collision over a right turn. This is one of many reasons that large companies like UPS program their GPS software so that it almost never requires left turns.
Any driver that makes a dangerous turn and causes an accident can be held at fault through a civil claim. Depending on the circumstances of any crash liability could extend beyond that driver. If the driver of a landscaping truck was working at the time of an accident the company that they work for could be held at fault. As a general rule, companies are vicariously liable for the negligent actions of their employees. There are a number of steps that should be taken after any accident.
- Photos of the accident should be taken.
- Surveillance footage should be sought. Many intersections have traffic cameras as do many homes with security systems.
- Eye witnesses should be interviewed.
- The truck driver involved in any crash should be interviewed. Were they working at the time of the collision?
- An experienced motorcycle accident attorney should be contacted.
The family of any victim that died in a car accident may be able to seek justice through a wrongful death claim. New York law defines a “wrongful death” as any death caused by “a wrongful act, neglect or default,” of a kind that could have been pursued by the victim through a personal injury claim had they survived the accident. (N.Y. Est. Powers & Trusts Law § 5-4.1 (2021) Potential beneficiaries in a civil claim can include a victim’s spouse or children. Damages can help cover lost wages, medical bills as well as funeral and burial expenses. A wrongful death attorney can examine all of the unique facts of your case and let you know what your legal options are.
