Two Workers Injured In Orchard Beach Construction Collapse

Collapse At Orchard Beach Pavilion Left Two People Seriously Injured

Two Workers Injured In Orchard Beach Construction Collapse

ORCHARD BEACH, NEW YORK (July 19, 2023) – Two construction workers were seriously injured in a construction collapse at the Orchard Beach Pavilion.

Orchard Beach officials are saying that the accident took place around 10:56 a.m. on Thursday. A 20-by-15 feet piece of concrete fell on two workers leaving them seriously injured.

It remains unclear what caused the concrete to collapse. Firefighters and paramedics were called to the scene of the accident in order to help both victims.

They were taken to Jacobi Hospital in serious condition. A full investigation into the Orchard Beach collapse remains ongoing at this time.

Liability For Orchard Beach Construction Collapses

Thousands of workers are seriously injured every year across the United States. According to the Bureau of Labor Statistics, “Falls, slips, and trips accounted for 35.3 percent of the workplace deaths within construction and extraction occupations in 2020. Workers in construction and extraction occupations experienced 21,400 nonfatal workplace injuries and illnesses due to falls, slips, and trips.” Many accidents also involve structure collapses. There are a number of common causes of structure collapses.

  • A structure may lack proper wall or ceiling support.
  • A wall may have excessive amounts of moisture.
  • A wall or ceiling may have design flaws.
  • A building may be comprised of old or inadequate building materials.

Pursuant to New York Labor Law 200, construction companies must provide workers with a reasonably safe environment for employees and those lawfully frequenting work sites. The statute requires, “All machinery, equipment, and devices in such places shall be so placed, operated, guarded, and lighted as to provide reasonable and adequate protection to all such persons.” When a workplace is not maintained in a reasonably safe way and this leads to a collapse, that could form the basis of a civil claim.

According to New York Labor Law § 240, general contractors and building owners must take steps to protect workers from falls and from being hit by falling objects. Most gravity related accidents are preventable. They tend to involve instances where safety regulations are being violated. Victims of construction accidents tend to suffer very serious and costly injuries including:

  • Broken bones
  • Head injuries
  • Lacerations
  • Spinal cord injuries
  • PTSD

Any person injured in a construction accident may be able to seek some aid through a civil claim. Damages in a civil claim can help cover many of the expenses that often come with a serious accident. Sadly, though, construction companies will often do everything in their power to deny liability for any workplace accident. A construction accident attorney can examine all of the unique facts of your case and let you know what your legal options are.
