Liability For New York DUI Accidents
Thousands of people are killed or seriously injured in car accidents involving drunk drivers. According to the NHTSA, “Every day, about 32 people in the United States die in drunk-driving crashes — that’s one person every 45 minutes. In 2020, 11,654 people died in alcohol-impaired driving traffic deaths — a 14% increase from 2019. These deaths were all preventable.” Even moderate amounts of alcohol can substantially impair drivers in the following ways.
- Drivers with a blood alcohol content (BAC) of 0.05% or higher have a hard time staying in their lane.
- Drivers with a blood alcohol content (BAC) of 0.05% or higher have delayed reaction times.
- Drivers with a blood alcohol content (BAC) of 0.05% or higher have reduced coordination.
It is illegal for any driver to operate their vehicle with a BAC of 0.08% or higher. If a driver causes an accident while intoxicated, they may face criminal as well as civil liability. Commercial drivers are held to an even stricter standard. They must not drive with a BAC of 0.04% or higher. The family of any person that died in a car accident may have legal recourse through a wrongful death claim.
