Liability In Manhattan Apartment Fires

Fires are one of the leading causes of injury and death in the United States. According to Statista, “In 2020, fires in one- and two-family homes accounted for 2,230 fatalities in the United States. In that same year, about 350 civilians died in apartment fires, and 580 civilians died in fires in highway vehicles.” There are a number of common causes of residential fires.

  • Cooking accidents
  • Electrical malfunctions
  • lit candles
  • Space heaters

Depending on the facts of any case, there could be numerous liable parties for an apartment fire. Property owners have a legal obligation to maintain their buildings in a reasonably safe condition. This includes being compliant with all NYC fire codes. Failure to maintain a property in a reasonable condition could form the basis of a negligence claim. For example, an apartment may not have functional sprinklers. There are a number of steps that should be taken after any apartment fire.

  • Surveillance footage should be sought.
  • The source of the fire should be determined.
  • Eye witnesses should be interviewed.
  • Medical records should be preserved.

The family of any victim that died in an apartment fire may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. A wrongful death attorney can examine all of the unique facts of your case and let you know what your legal options are. It’s important to remember that there are statute of limitations associated with civil claims.
