Liability In Troy Car Accidents

Thousands of people are killed or seriously injured in electric scooter accidents every year. According to New Atlas, “One 2020 study published in JAMA Surgery found the incidence of annual e-scooter injuries in the US climbed from 4,582 in 2014, before the emergence of ride-share scooter companies, to 14,651 in 2018, when they had become far more commonplace.” There are a number of factors that could potentially contribute to a scooter accident.

  • Speeding
  • Drunk driving
  • Driver distraction
  • Inclement weather

All drivers have a legal obligation to exercise due care in order to avoid collisions. Many collisions are due to drivers that are speeding. Pursuant to New York Vehicle Code 1180, no person shall operate a motor vehicle at a speed greater than would be reasonable or safe given the prevailing conditions of the roadway. If a driver fails to reduce their speed and hits a scooter rider, this could form the basis of a negligence claim. Victims of scooter accidents tend to suffer very serious and costly injuries including:

  • Broken bones
  • Head injuries
  • Lacerations
  • Spinal cord injuries

Any person that is injured in a car accident may have legal recourse through a bodily injury claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. Sadly, though, drivers will often fight extremely hard to deny liability for any collision. A scooter accident attorney can examine all of the unique facts of your case and let you know what your legal options are.
