Liability In Bronx Hit-And-Run Car Accidents

Thousands of people are killed or seriously injured in hit-and-run collisions every year. According to one report from the AAA Foundation, “There were an estimated 737,100 hit-and-run crashes in 2015 (NHTSA, 2016). This translates to a hit-and-run crash happening somewhere in the U.S. every 43 seconds. The 2,049 fatalities that resulted from hit-and-run crashes in 2016 were the highest number ever recorded (NHTSA, 2017).” A number of factors could potentially contribute to a hit-and-run collision including:

  • Speeding
  • Drunk driving
  • Inclement weather
  • Distracted driving

All drivers have a legal obligation to exercise due care to avoid hitting pedestrians. When a car drives into a restaurant, “pedal confusion” is often to blame. Pedal confusion occurs when a driver mistakes the gas pedal for the brakes. A restaurant could also potentially be for a car accident if they failed to take adequate measures to protect guests from errant vehicles. Bollard posts, for example, are sturdy concrete or medal structures capable of stopping vehicles from traveling into certain areas. There are many steps that should be taken after a car accident.

  • Surveillance footage should be sought.
  • Eye witnesses should be interviewed.
  • Medical records should be preserved.
  • An experienced car accident attorney should be consulted.

Any person that is injured in a car accident may be able to seek justice through a bodily injury claim. Damages can help cover lost wages, medical bills and pain and suffering. It’s important that evidence is preserved after an accident. A New York City car accident attorney can examine all of the facts of your case and let you know what your legal options are.
