Liability In Manhattan Car Accidents

Speed remains one of the most common causes of car accidents in the United States. According to the National Safety Council, “Speeding was a factor in 29% of all traffic fatalities in 2020, killing 11,258, or an average of over 30 people per day. The total number of fatal motor-vehicle crashes attributable to speeding was 10,136.” There are many other factors that could contribute to a car accident.

  • Distracted driving
  • Inclement weather
  • Drug use
  • Poor road conditions

All drivers have a legal obligation to exercise due care in order to avoid accidents. Head-on collisions tend to occur when drivers make unsafe lane changes. If a driver enters into opposing lanes of traffic prior to a crash, this could form the basis of a negligence claim. There are a number of steps that need to be demonstrated in any negligence claim.

  • The defendant owed the plaintiff a legal duty of care.
  • The defendant breached that legal duty of care.
  • The plaintiff suffered and injury.
  • The defendant’s breach was the proximate cause of the injury.

The family of any person  that is killed in a car accident may have legal recourse through a bodily injury claim. Damages in a civil claim can help cover many of the unexpected expenses that come with the sudden loss of a loved one. A wrongful death attorney can examine all of the unique facts of your case and let you know what your legal options are.
