Liability For Livingston Manor Pedestrian Accidents
Pedestrians lack the protection of enclosed vehicles and are much more likely to be overlooked. According to the IIHS, “Pedestrian motor vehicle crash deaths have increased 80 percent since reaching their low point in 2009 and account for 17 percent of crash fatalities. The rates of pedestrian deaths in motor vehicle crashes per 100,000 people are highest for people ages 20-69.” There are a number of factors that could contribute to a pedestrian collision.
- Speeding
- Distracted driving
- Inclement weather
- Poor road conditions
All drivers must use caution to avoid hitting pedestrians. This is true even if a pedestrian is in the middle of the road. When drivers fail to use caution to avoid pedestrians, they could be held at fault through a civil claim. The family of any person that is killed in a pedestrian accident may have legal recourse through a wrongful death claim. It is important that all evidence is properly preserved after any collision.
