Liability In Greenburgh Box Truck Accidents

Nearly 4,000 people are killed every year in accidents involving commercial trucks. Tens of thousands more are left with serious injuries that require hospitalization. There are a number of factors that could contribute to a semi-truck collision. According to the FMCSA, “Fatigue, drinking alcohol, and speeding are major factors in motor vehicle crashes overall. Although their presence does not always result in a crash, these three factors, as well as other driver, vehicle, and environmental factors, can increase the risk that a crash will occur.” There are also many ways that semi-trucks can be particularly dangerous.

  • Commercial trucks have large blinds that can easily obscure the presence of smaller vehicles.
  • Commercial trucks can take the length of two football fields to come to a complete stop.
  • Commercial truck drivers are often pushed to work long hours and can be affected by fatigue.

All commercial truck drivers must get a commercial driver’s license (CDL) and are held to a high standard in terms of safety. If a truck driver makes an unsafe lane change they can be held at fault in the event of a collision. According to New York Vehicle & Traffic Law § 1128(a), “A vehicle shall be driven as nearly as practicable entirely within a single lane and shall not be moved from such lane until the driver has first ascertained that such movement can be made with safety.” Depending on the specific facts of any case, liability for a collision could extend beyond a truck driver.

A truck company in New York could be liable for the negligent actions of their employees. Generally speaking, trucking companies in New York can be vicariously liable for the negligent actions of their truck drivers. But many truck companies will try to evade liability for collisions involving their drivers. They may try to do this by hiring their driver’s as “independent contractors.” However, many truck drivers are improperly categorized as independent contractors. There are a number of steps that should be taken after any truck accident.

  • Victims should seek medical attention as early as possible.
  • Eye witnesses should be interviewed.
  • Surveillance footage should be sought.
  • A thorough, independent investigation should be conducted.

The FMCSA requires commercial trucks to carry between $750,000 – $5,000,000 worth of liability coverage. Any person that is injured in a box truck accident may be able to seek justice through a bodily injury claim. Many victims often don’t realize the full extent of their injuries until several weeks or months after a collision. A New York truck accident attorney can examine all of the unique facts of your case and let you know what your legal options are.
