Three-Year-Old Killed In Accident At New York City Apartment After Falling Out of 3rd Floor Window

Three-Year-Old Died In Harlem Window Fall Accident At Apartment Building

MANHATTAN, NEW YORK (July 6, 2022) – A three-year-old child has tragically died after falling out of a 3rd floor apartment window in Harlem.

New York City police officials are saying that the accident took place on Saturday morning. A child was able to exit through a window and fell nearly three stories below.

Firefighters and paramedics were called to the scene of the collision in order to help the child. Sadly, the child died from their injuries.

A full investigation remains ongoing at this time.

Liability In Harlem Window Fall Accidents

Falls are one of the leading causes of serious injury and death for children. According to one report from the Stanford Children’s Hospital, “It is estimated that more than 2.2 million children ages 14 and under are treated annually at hospital emergency rooms for fall-related injuries. More than half of fall-related injuries among children occur among ages 4 and under.” There are a number of places where falls are likely to occur.

  • At home
  • At school
  • At the playground
  • On any set of stairs

Property owners in New York have a legal responsibility to maintain their premises in a reasonably safe condition. They could be liable for any accident caused by a dangerous condition on their premises.  According to the Department of Housing Preservation and Development, “In all buildings with three or more apartments, New York City (NYC) law requires that building owners install window guards if a child age 10 years or younger lives there, or if the tenant or occupant requests window guards for any reason.” If a landlord failed to install window guards at a unit where a child lived, this could form the basis of a negligence claim. There are a number of steps that should be taken after any window fall accident.

  • Maintenance records for the apartment should be sought.
  • Medical records should be preserved.
  • Eye witnesses should be interviewed.
  • A thorough, independent investigation should be conducted.

The family of any child that died in a window fall accident may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover many of the unexpected expenses that can come with the sudden loss of a loved one. Sadly, though, property owners will often fight hard to deny liability for any accident. A wrongful death attorney can examine all of the facts of your case and let you know what your legal options are.
