Liability In Westchester County Truck Accidents
Thousands of people are killed or seriously injured every year in accidents with commercial trucks. According to one report by the Insurance Institute for Highway Safety (IIHS), “A total of 4,119 people died in large truck crashes in 2019. Sixteen percent of these deaths were truck occupants, 67 percent were occupants of cars and other passenger vehicles, and 15 percent were pedestrians, bicyclists or motorcyclists. The number of people who died in large truck crashes was 31 percent higher in 2019 than in 2009.” There are many different factors that could contribute to a truck accident.
- Driver distraction
- Following the lead vehicle too closely
- Driver intoxication
Commercial truck drivers must get a commercial license and are held to a high standard in terms of safety. They must also maintain a safe distance with the vehicle ahead of them. Pursuant to New York Vehicle & Traffic Law § 1129(a), the driver of a motor vehicle must not follow a vehicle more closely than what is reasonable and prudent given the prevailing conditions of the roadway. There is a rebuttable presumption of negligence when a driver rear-ends another vehicle.
A truck driver could also be held at fault for a collision if they made a dangerous lane change in the roadway. According to New York Vehicle & Traffic Law § 1128(a), drivers may not move from a single lane on the roadway until such a movement can be made with reasonable safety. Victims of truck accidents tend to suffer very costly and serious injuries including:
- Broken bones
- Head injuries
- Spinal cord injuries
- Organ damage
The FMCSA requires most commercial trucks to carry between $750,000 – $5,000,000 worth of liability coverage. Any person that is injured due to the negligent actions of a truck driver may be able to seek aid through a bodily injury claim. Damages can help cover lost wages, medical bills and pain and suffering.
