Liability In Bronx Apartment Fires
Many people are seriously injured or killed by residential fires every year. This is especially true in large urban areas like New York City where many people live close to one another in the same building. According to one report from the New York Post, “The number of people who died in fires in New York City climbed 16 percent in 2021 — with 73 fatalities compared to 63 in 2020, FDNY data show. Queens was the deadliest borough with 23 fire deaths, followed by Manhattan (19), the Bronx (16), Brooklyn (14) and Staten Island (1).” There are dozens of potential contributing factors for residential fires.
- Unattended cooking is one of the leading causes of residential fires. Make sure to always stay in the room where you are cooking.
- Heating equipment is another major contributing factor in residential fires. A deadly fire that killed 19 people in the Bronx was blamed on a malfunctioning space heater.
- Faulty wiring could also potentially lead to a home fire. This is one of the reasons why wiring should always be done by a trained professional. One of the signs of faulty wiring occurs if the lights in a room are dim when an appliance is being used.
Depending on the specific facts of any case, there could be numerous sources of liability for an apartment fire. For starters, all building owners have a legal responsibility to maintain their premises in a reasonably safe condition. Landlords must do periodic maintenance on their property and make sure their building is compliant with the fire code. In many situations, this includes installing self-closing doors, as required by law in NYC. When a property owner is a aware of a dangerous condition on their property and they fail to take action, they could be responsible for damages.
The manufacturer of a product could also possibly be liable for an accident. Companies have a legal responsibility to create products that are reasonably safe. They must also warn about the non-obvious dangers associated with the use of their products. Products with lithium ion batteries pose a potential fire risk. For example, a deadly house fire in Queens was blamed on a faulty scooter battery. There are a number of steps that should be taken after any New York City apartment fire.
- Victims should seek medical attention as soon as possible.
- Eye witnesses should be interviewed.
- Medical records should be preserved.
- Maintenance records should be examined.
