Liability For Louisville Express Bus Accidents

Bus accidents are much more common than many people may realize. According to the Journalist’s Resource, “about 63,000 buses [of all kinds] are involved in an accident each year; about 14,000 result in an injured person, and 325 result in a fatal injury.” The vast majority of bus accidents are preventable and involve some amount of human error. There are many factors that could contribute to a bus accident.

  • Distracted driving
  • Inclement weather
  • Driver fatigue
  • Poor road conditions

All bus drivers must get a commercial driver’s license and are held to a high standard in terms of safety. Pursuant to New York Vehicle & Traffic Law § 1163, “No person shall turn a vehicle at an intersection […] or move right or left upon a roadway unless and until such movement can be made with reasonable safety.” If a driver makes an abrupt lane change, this could form the basis of a negligence claim. There are many steps that should be taken after any bus accident.

  • Eye witnesses should be interviewed.
  • Medical records should be preserved.
  • Surveillance footage should be sought.
  • Work records from all commercial drivers should be reviewed.

It can be hard to know where to begin after any bus accident. But it is important for accident victims to know that they do have rights. The family of any person that is killed in a bus accident may have legal recourse through a wrongful death claim. A wrongful death attorney can examine all of the unique facts of your case and let you know what your legal options are.
