Liability For North Bellmore Walmart Truck Accidents
Semi-trucks are used to transport the vast majority of goods that are bought and sold every year. They are essential for the economy, but they can also be very dangerous for those in passenger vehicles. According to the National Safety Council, “In 2021, 5,700 large trucks were involved in a fatal crash, an 18% increase from 2020 and a 49% increase in the last 10 years. The involvement rate per 100 million large-truck miles traveled is up 7% from 2020, and up 22% in the last 10 years.” There are a number of steps that truck companies should take to prevent collisions.
- Trucks should be periodically inspected and well maintained.
- Truck drivers should not be asked to worked beyond legal limits.
- Truck drivers should be well trained and have a commercial license.
Operating a commercial truck is much more difficult than operating a passenger vehicle. Truck drivers must use a great deal of care to avoid collisions. Many truck accidents are due to one or more drivers that are speeding. Pursuant to New York Vehicle Code 1180, no person shall drive a motor vehicle at a speed greater than would be reasonable or safe given the prevailing conditions of the roadway. If a driver fails to exercise due care and hits another vehicle, this could form the basis of a negligence claim. Victims of truck accidents tend to suffer very serious injuries including:
- Broken bones
- Head injuries
- Spinal cord injuries
It can be hard to know where to begin after any truck accident. Many accident victims may not be able to return to work for significant periods. However, it is important to remember that accident victims do have rights. Any person that is injured in a truck accident may have legal recourse through a civil claim. Damages in a civil claim can help cover many of the expenses that often come with a serious collision.
