Liability In New York School Bus Accidents

School buses are typically very safe and most of those seriously injured in crashes are pedestrians. According to Injury Facts, “From 2010 to 2019, about 69% of the deaths in school bus-related crashes were occupants of vehicles other than the school bus, and 17% were pedestrians. About 6% were school bus passengers, 5% were school bus drivers, and 3% were pedalcyclists.” There are a number of factors that could potentially contribute to a school bus accident.

  • Speeding
  • Inclement weather
  • Driver fatigue
  • Distracted driving

School bus drivers must get a commercial driver’s license and are held to a high standard in terms of safety. If a bus driver rear-ends another vehicle they will typically be held at fault for the crash. There is a rebuttable presumption of negligence on the part of any person that hits another vehicle from behind. The vast majority of rear-end collisions are due to drivers that are speeding, distracted or following the lead vehicle too closely. Victims of bus accidents tend to suffer very serious and costly injuries including:

  • Broken bones
  • Head injuries
  • Lacerations
  • Spinal cord injuries

The FMCSA requires buses that can carry 16 or more passengers to carry at least $5,000,000 worth of liability insurance. Any person that is injured in a school bus accident may have legal recourse through a bodily injury claim.  Damages can help cover lost wages, medical bills and pain and suffering. Many victims may not realize the full extent of their injuries for several weeks or months after an accident. A school bus accident attorney can examine all of the facts of your case and let you know what your legal options are.
