Liability In New York City Scooter Accidents
There has been a sharp rise in the number of people using electric scooters. This is largely due to the rise of companies like Lime and Bird. But this has also coincided with a sharp increase in the number of scooter accidents every year. According to one report by USA Today, “The scooter injury rate among the general U.S. population climbed from 6 per 100,000 to 19 per 100,000. Most occurred in riders aged 18 to 34, and most injured riders weren’t hospitalized.” There are a number of factors that could potentially contribute to a scooter accident including:
- Distracted driving
- Driver intoxication
- Inclement weather
Every driver has a legal obligation to exercise due care in order to avoid pedestrians in the roadway. When a driver fails to yield to a pedestrian they could be held at fault through a civil claim. If they were working at the time of a collision, the company that they were working for could be held at fault. Generally speaking, companies are liable for the negligent actions of their employees. The family of any victim that died in a scooter accident may be able to seek aid through a wrongful death claim. A scooter accident attorney can examine all of the unique facts of your case and let you know what your legal options are.
