Liability In Medford Pedestrian Collisions
Thousands of pedestrians are killed or seriously injured every year in the United States. Elderly pedestrian and children are at the greatest risk of being involved in collisions. According to the Centers for Disease Control, “Pedestrians aged 65 and older accounted for 20% of all pedestrian deaths and an estimated 10% of all pedestrian injuries in 2017. One in every five children under the age of 15 killed in traffic crashes were pedestrians in 2017.” There are a number of common causes of pedestrian accidents.
- Distracted driving
- Drunk driving
- Inclement weather
- Driver fatigue
All drivers in New York have a legal obligation to exercise due care in order to avoid hitting pedestrians. But this does not always happen. Many collisions take place when drivers are speeding or making dangerous turns in an intersection. When a driver fails to exercise due care and hits a pedestrian they can be held accountable through a civil claim. The family of any pedestrian killed in a collision may have recourse through a wrongful death claim. It’s very important that evidence is properly collected after an accident.
