Advocates want additional safety measures in the area to help keep pedestrians safe. A full investigation remains ongoing at this time.

Liability For Brooklyn Truck Accidents

Far too many people are killed or seriously injured in semi-truck accidents every year. According to the IIHS, “There were 35,766 fatal motor vehicle crashes in the United States in 2020 in which 38,824 deaths occurred. This resulted in 11.7 deaths per 100,000 people and 1.34 deaths per 100 million miles traveled. The fatality rate per 100,000 people ranged from 4.9 in Massachusetts to 25.4 in Mississippi.” There are a number of steps that truck companies should take to avoid collisions.

  • Truck drivers should be well trained.
  • Trucks should be regularly inspected and properly maintained.
  • Trucks can be equipped with safety features such as forward collision avoidance systems.

All truck drivers must exercise due care to avoid hitting pedestrians. Many accidents are due to speeding. Pursuant to New York Vehicle Code 1180, no person shall drive a motor vehicle at a speed greater than would be reasonable or safe given the prevailing conditions of the roadway. If a driver fails to slow down to avoid hitting a pedestrian, this could form the basis of a negligence claim. Victims of pedestrian accidents tend to suffer very serious and costly injuries including:

  • Broken bones
  • Head injuries
  • Lacerations
  • Spinal cord injuries

It can be hard to know where to begin after any truck accident. To make matters worse, truck companies will often fight hard to deny liability for any collision. It is important for accident victims to know that they do have rights. The family of any person that is killed due to the negligence of a truck driver may have legal recourse through a wrongful death claim. A pedestrian accident attorney can examine all of the unique facts of your case and let you know what your legal options are.
