MANHATTAN, NEW YORK CITY (December 14, 2021) – A scooter rider identified as Salvador Navarette-Flores has tragically died in a collision with a box truck by the intersection of 1st Avenue and East 76th Street.

New York City police officials are saying that the collision took place around 5:10 p.m. on Monday, December 13th. Salvador Navarette-Flores was riding a Jiajue scooter going northbound on 1st Avenue when he lost control of the scooter.

The man veered to the left and collided with an illegally parked box truck in the bicycle lane. Paramedics were called to the scene of the collision in order to help the victim.

Despite life-saving measures the moped rider died due to the severity of their injuries. The executive director of Transportation Alternatives said that Salvador Navarette-Flores was a member of Los Deliveristas Unidos.

This organization represents food delivery workers across the city. It remains unclear if the driver of the truck will receive any citations for illegally parking in the bicycle lane.

A full investigation into the collision remains ongoing at this time.

Liability In Upper East Side, Manhattan Scooter Accidents

The rise of companies like Bird and Lime have led to a sharp increase in the number of people actively using motorized scooters every year. This has also come with a sharp increase in the number of people seriously injured in scooter accidents. According to one report from the Consumer Product Safety Commission, “e-scooters resulted in an estimated 50,000 emergency department visits and at least 27 fatalities between 2017 and 2019, with injuries and deaths on the rise year over year.” There are a number of factors that have contributed to this trend.

  • Scooters are being used for food delivery services.
  • Scooter riders often lack experience with how their vehicle handles.
  • Only 2% of scooter riders report wearing a helmet.
  • Scooter riders have a small profile and are more likely to be overlooked.

Depending on the specific facts of any case, there could be numerous sources of liability for a New York City scooter accident. For example, the company that created an e-scooter could potentially be liable for an accident through a  product liability claim. Companies that manufacture scooters have a legal obligation to ensure that they are reasonably safe. When a scooter company creates a product with a design defect, manufacturing defect or they fail to warn about the dangers of their products they could be liable in the event of a collision. There are a number of ways that e-scooters are reported to have malfunctioned, which has led to numerous lawsuits.

  • Scooter stems could collapse.
  • The brakes could give out.
  • The accelerator could stick.
  • The wheels can become misaligned.

A truck driver could also be liable for an accident if they were illegally parked. Generally speaking, truck drivers will be at least comparatively negligent for an accident if someone hits them while they are illegally parked.  In certain circumstances, if it is very difficult for a driver to see an illegally parked vehicle, that driver could be 100% responsible for the crash. Liability may also flow to a truck driver’s employer if they were working as an employee at the time of a collision. There are a number of steps that should be taken after any truck accident.

  • Photos of the accident site should be taken.
  • Surveillance footage should be sought.
  • A truck driver’s work records should be examined.
  • The truck driver that illegally parked a vehicle should be interviewed.
  • An experienced truck accident attorney should be consulted.

The family of any victim that died in a truck may be able to seek aid through a wrongful death claim. Damages in a civil claim can help cover lost wages, medical bills and funeral costs. It is important that evidence is properly preserved after an accident. A New York City scooter accident attorney can examine all of the unique facts of your case and let you know what your legal options are.
