Liability For Long Island Roof Fall Accidents
Falls are one of the leading causes of workplace injury and death in the construction industry. In fact, falls are one of the four types of accidents dubbed the “Fatal Four” by OSHA. The other three main types of workplace hazards include electrocutions, being struck by objects and getting caught in-between hazards. In all, the “Fatal Four” types of hazards made up nearly 64% of all workplace deaths in 2016. There are a number of common causes of workplace falls including:
- Slick surfaces
- A lack of protective guardrails
- A lack of personal fall arrest systems (PFAS)
- Poorly constructed scaffolds
Most gravity related construction accidents that occur in New York are adjudicated under New York State Labor Law § 240/241. In short, building owners and general contractors are held strictly liable when a worker falls and is injured. A construction company could also be held liable for a construction accident under New York Labor Law 200. Under this statute companies have a legal obligation to provide their workers with a reasonably safe environment. Victims of construction falls tend to suffer very serious and costly injuries including:
- Broken bones
- Head injuries
- Lacerations
- Spinal cord injuries
It can be difficult to know where to begin after any construction accident. But it is important to remember that accident victims do have rights. They have the ability to seek damages through a civil claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. A wrongful death attorney can examine all of the facts of your case and let you know what your legal options are.
