Liability In Fulton Pedestrian Accidents

Thousands of pedestrians are killed or seriously injured every year in car accidents. According to the Centers for Disease Control, “More than 7,000 pedestrians were killed on our nation’s roads in crashes involving a motor vehicle in 2020. That’s about one death every 75 minutes.” The vast majority of pedestrian accidents are preventable and involve some amount of human error. There are a number of steps that drivers should take in order to avoid hitting pedestrians.

  • All drivers should scan the road ahead of them for hazards.
  • All drivers should slow down in areas with heavy pedestrian traffic.
  • All drivers should check their blind spots before making turns.

Every driver has a legal obligation to exercise due care in order to avoid hitting pedestrians. A large number of pedestrian collisions are due to drivers that are speeding. Pursuant to New York Vehicle Code 1180, no person shall drive a vehicle at a speed greater than what would be safe or reasonable given the prevailing conditions of the roadway. Victims of pedestrian collisions tend to suffer very serious injuries including:

  • Broken bones
  • Head injuries
  • Lacerations
  • Spinal cord injuries
  • Organ damage

Any person that is injured due to the negligence of another driver may have legal recourse through a bodily injury claim. Damages in a civil claim can help cover many of the unexpected expenses that can come with a serious injury. It is extremely important that evidence is properly preserved after any collision. A pedestrian accident attorney can examine all of the unique facts of your case and let you know what your legal options are.
