Liability For Minor Sexual Abuse By School Officials
Sexual abuse at the hands of school officials is far more common than many people realize. According to Data From the U.S. Department of Education, around 10% of students experience sexual misconduct by a teacher at some point during their K-12 school experience. There are a number of steps that school districts should take in order to protect children from sexual abuse.
- Teachers and school officials should be properly monitored.
- Teachers and school officials should be properly trained.
- Teachers and school officials should be properly vetted before they are hired.
A school district could be liable if a student in their care is sexually abused. As explained in Mirand v City of New York, “Schools are under a duty to adequately supervise the students in their charge and they will be held liable for foreseeable injuries proximately related to the absence of adequate supervision.” If a school district knew (or should have known) about an employee’s history of sexual abuse, this could also form the basis of a negligence claim. There are many steps that should be taken after any instance of sexual abuse.
- The offending party should be reported to police.
- Surveillance footage should be sought.
- The scope of abuse among other students should be determined.
- A thorough, independent investigation should be conducted.
The family of any victim that is sexually abused by school officials or bus drivers may have legal recourse through a civil claim. Damages can help cover medical bills and pain and suffering. Victim’s of sexual abuse are at a greater risk for chronic illness and suicidal ideations. A personal injury attorney can examine all of the facts of your case and let you know what your legal options are.
