He was cycling down Second Ave in Manhattan when a motorist, whose view was obstructed by an illegally parked car, drove through a bike lane without yielding and struck a bicyclist. The bicyclist was seriously injured and ambulanced away just before the NYPD arrived at the scene. The police spoke with the motorist and with some witnesses. They then left the scene without issuing a summons to the driver for failing to yield or issuing a ticket to the car that was illegally parked.
Even though the police let the motorist go, it does not mean that he did not cause the crash and was not responsible for the bicyclist’s injuries. And just because the driver was not issued a citation, it does not mean that he should not be held civilly liable for the injuries.
