Facts of the Accident
On September 7, 2017, plaintiff Zhen, 43, was struck by a truck on Richmond Road, alongside its intersection at Steuben Street, in the Concord section of Richmond County. The truck’s driver, Meyer, was attempting a left turn on Richmond Road, from Steuben Street when he struck Zhen while she was in the crosswalk. The lawsuit alleged that the vehicle’s owner, Safety-Kleen Systems, Inc., was vicariously liable for Meyer’s actions.
Zhen suffered serious injuries upon impact, including a comminuted, displaced fracture of the right femur, fractures of her pelvis’s and pubis ramus, a fracture of her right sacrum, and degloving injuries of portions of her buttocks and thighs. She was ambulanced to a nearby hospital where she underwent open reduction, internal fixation and external fixation of her fractures. She was hospitalized for about two months and underwent another three months of physical therapy.
Zhen continues to suffer pain in her back and thighs, which significantly limit her functionality. She sought recovery of damages for past and future pain and suffering.
