Preparing for a New York Car Accident Deposition

Car Accident AttorneyIf you are involved in a car accident and file a lawsuit against the party that injured you, the defense attorney may ask you to appear for a deposition. Attending a deposition can be a stressful and overwhelming experience. However, to be successful in a car accident case it is essential that you make a strong impression during a deposition. A New York car accident attorney will help you feel confident and calm throughout your deposition.

During the deposition, answer all questions completely and honestly. Remember, you are under oath during a deposition and a court reporter will record all your answers. For example, do not exaggerate the facts of the case or any injuries you have sustained because of the accident. In addition, if you are unclear about whether you should answer a question, ask your New York car accident attorney. During a deposition, an attorney will object to questions that are privileged or inappropriate and an attorney will inform you about whether you should answer a question.

Before you begin to answer a question, make sure that you fully understand the meaning of the question. For example, if you do not understand the defense attorney’s question, ask the defense attorney to rephrase the question to resolve the ambiguity. In addition, only answer the question the defense attorney asks you; do not provide additional details or information beyond the scope of the question. You must answer all questions even if you think they are irrelevant or repetitive. Beware of questions that ask you to estimate time, speed or distance. Estimated answers cause you to give an answer that you are unsure of, and if you cannot answer something with complete certainty, do not offer an answer. It is also advisable to pay attention to any errors the defense attorney makes if they repeat your answer back to you. Many times a defense attorney will restate your answer in an incorrect way to dispute your testimony at trial.
