Liability For Yonkers Pedestrian Accidents
Drivers are much more likely to lose control of their vehicle if they are speeding. According to the National Highway Traffic Safety Administration, “For more than two decades, speeding has been involved in approximately one-third of all motor vehicle fatalities. In 2019, speeding was a contributing factor in 26% of all traffic fatalities.” There are many situations where a driver may need to operate their vehicle below the speed limit.
- Heavy rain
- Heavy fog
- Sharp curves in the roadway
- At night
All drivers have an obligation to exercise due care in order to avoid collisions. Pursuant to New York Vehicle Code § 1180, no person shall drive a motor vehicle at a speed greater than would be safe and reasonable given the prevailing conditions of the roadway. When a driver fails to slow down and kills a pedestrian, this could form the basis of a negligence claim.
